I've now added a text, on the post page, that says

Quote
Please do not post any material that might be copyrighted! Especially any articles from the following publications may not be quoted and preferrably not even linked to:

Las Vegas Review-Journal
Arkansas Democrat-Gazette
Chattanooga Times Free Press
Denver Post

This is simply because of the fact that we might get sued.

I'll see if I can make it a bit more noticeable than it is now, but together with some proactive modding, we should hopefully be pretty safe from lawsuits.

I'd just say to not post any paterial from other sources without permissionAL ALL.  It doesn't matter what the source is.  Just post a link.  Nothing more.

We should keep in mind that copyright is implied most of the time.  Copyright notice does not have to be posted for copyright laws to protect the author or owner.

You may be able to get away with copyright violation, but that doesn't make it right.

There is an interesting defense possible here. Who is to say it was not the Denver Post, posing as a user, who posted the infringing material in order to collect $150,000? Since the postings are anonymous, the rulings as currently made allow anyone with a chip on their shoulder to post something copyrighted and then sue at will. This is not a tenable state of affairs.

In reality, the posting are only slightly anonymous. Like here, when you post your IP address is recorded. A court subpoena could be issued and the service provider could be forced to resolve their logs (that track all your actions) and identify which subscriber was using the logged IP address at the time of the posting.

I would certainly check that if I were on the defense, who knows, it might have been the DP?????

Completely agree!! Keep the members away from posting copyrighted or POTENTIALLY copyrighted material.  I wouldn't enact any punitive measures just edit the post and notify them not to post more than a link.  I'd also say something about it in the TOS and forum rules .....   :twocents:  :twocents:

I just posted something in the Tea Room that was only supposed to be a link, but the whole YouTube video appeared. Is that bad?

The thread is "What are you listening to right now."

It is an imbedded video that is still only resident on Youtube. It isn't a copy and paste, but a "better" link to the source material....

Just to clarify, the words of Shakyamuni are now out of copyright and may be quoted here.

Of course, he may nevertheless sue for defamation if a misquote ruins his reputation!  ;D
